Mountain View Man Faces Murder Charges After DUI Crash Resulting in Death of Pregnant Woman
GILROY — A 50-year-old man from Mountain View, identified as Jesus Carlos Temores, has been charged with murder following a tragic New Year’s Day traffic accident that resulted in the deaths of a pregnant woman and her unborn child. This incident occurred when Temores allegedly drove under the influence, with a blood-alcohol level reported to be over twice the legal limit.
The Santa Clara County District Attorney's Office has charged Temores with two counts of murder related to the fatalities of 29-year-old Rachel Marie Gonzalez Gallegos and her five-month-old fetus. Additionally, he faces a charge of driving under the influence causing injury stemming from the injuries sustained by another driver involved in the crash.
According to California law, the murder charges were brought under what is known as the Watson murder theory. This applies to defendants with prior DUI convictions who are required to acknowledge the dangers associated with impaired driving and undergo educational programs regarding the risks of driving under the influence. In this case, prosecutors assert that Temores' actions constituted implied malice, suggesting he knowingly engaged in behavior likely to cause serious harm.
The incident occurred around 6:30 p.m. on January 1, when Temores reportedly crossed double-yellow lines, resulting in a head-on collision with another vehicle, followed by another impact with a different car. Tragically, Gonzalez Gallegos and her unborn child were transported to a hospital where they later succumbed to their injuries.
Additional injuries were reported among the other individuals involved, including a man in the second vehicle who suffered a head injury and a young child who received treatment for minor injuries.
Following the crash, authorities observed signs of alcohol intoxication in Temores, and his performance on sobriety tests indicated impairment. Breath tests showed blood-alcohol concentrations significantly above the legal limit.
Temores was set to appear in court for arraignment and is currently being held without bail. This case underscores the severe consequences associated with driving under the influence and serves as a reminder of the inherent risks involved.
